Los Angeles Sexual Orientation Discrimination Attorney

In 2020, the Supreme Court ruled in Bostock v. Clayton County, Georgia that terminating employees due to sexual orientation or transgender status was a violation of Title VII. Title VII of the Civil Rights Act of 1964 is a federal law prohibiting discrimination due to an individual’s sex or gender.

According to the Supreme Court, “discrimination based on homosexuality or transgender status necessarily entails discrimination based on sex; the first cannot happen without the second.”

If you are a member of the LGBTQ+ community in California who has suffered workplace harassment or discrimination, we can help. Our attorneys have handled a wide range of cases involving discrimination on the basis of sexual orientation or gender identity.

Since 1995, Hennig Kramer LLP has provided each client with compassionate yet aggressive legal representation. We believe everyone deserves to be treated with respect, and no one should suffer from workplace discrimination or harassment.

He was the founding co-chair of the board of directors for what is now Equality California. Mr. Hennig is also a past member of the board of directors and past president of the LGBT chapter of the ACLU of Southern California.

Identifying Harassment and Discrimination

Harassment based on a worker’s LGBT identity generally occurs when an employer creates or knowingly permits a hostile work environment. This adverse treatment is because of the employee’s sexual orientation or gender identification. This environment negatively affects the employee’s ability to perform their work and causes them mental and emotional distress.

Discrimination can manifest in many forms, including:

  • Refusal to provide necessary training
  • Rude or offensive comments or gestures
  • Ostracization and exclusion
  • Negative performance reviews
  • Disciplinary action
  • Retaliation
  • Denial of promotions, benefits, or other compensation
  • Wrongful termination

Some discrimination can be subtle and less visible than a wrongful termination or overt harassment. An employer may allow harassment, including sexual harassment, to continue when they’d otherwise put a stop to it.

Similarly, an employer may have unequal expectations for you as they do for your coworkers. They deny you preferential work assignments or schedules based on your sexual orientation or gender identification.

What to Do If You’re Experiencing Discrimination

If you are being discriminated against due to your membership in the LGBT community, it is crucial to document everything you can. You will also want to report the discrimination and harassment to your human resources department according to your company’s guidelines.

You should then consult with an employment discrimination lawyer experienced in handling LGBT cases, like ours at Hennig Kramer.
