Do I Have a Case?

Whether a potential client has a valid legal claim or not is a fact specific and detailed question. Generally speaking, our office looks for signs of discriminatory, harassing, or retaliatory conduct. There is a wide range of conduct that an employer is allowed to engage in that is not, per se, illegal. Conduct may become illegal if it is based upon a Aprotected characteristic. These protected characteristics include:

  • Age, if you are over 40
  • race or national origin
  • sex or gender
  • sexual orientation
  • disability or medical condition
  • marital status
  • family status
  • religion
  • resisting or reporting illegal conduct

Actions taken by an employer that may be illegal include:

  • Write-ups/discipline
  • Pay cuts
  • Refusal or failure to promote
  • Refusal or failure to hire
  • Refusal to transfer
  • Increased work responsibilities
  • Decreased work responsibilities
  • Reduction in work hours
  • Termination
